On behalf of the Michigan Council of Chapters of the Military Officers Association of America (MOAA) and the Commissioned Officers Association of the U.S. Public Health Service (USPHS), I respectfully urge you to advance a revised version of House Bill (HB) 5280, initiated in November 2025, which would amend 1967 PA 281, the Income Tax Act of 1967, to exempt from income tax the active duty pay and retirement or pension benefits received for service as a commissioned officer in the National Oceanic and Atmospheric Agency (NOAA) Corps of Officers or the USPHS Commissioned Corps.
The revision to the current version of the bill would amend section 30(1)(e)(iv) to read: "(iv) Beginning January 1, 2026, compensation, including retirement or pension benefits, received for services as a commissioned officer in the National Oceanic and Atmospheric Administration Commissioned Officer Corps or the United States Public Health Service Commissioned Corps."
The bill’s emphasis on parity between members the armed forces and the uniformed services as recognized in Title 38 USC, Veterans Affairs, would come at a low cost and minimal impact to the state, county, and municipalities after including this very small population of commissioned officers.
At the time of its introduction to the House Committee on Government Operations, HB 5280 received strong bipartisan support in the House before stalling in committee. This broad support demonstrates that caring for veterans transcends party lines and remains a priority for Michigan residents across the state.
Advancing this legislation would send a clear message that Michigan is committed to supporting those who served.
I respectfully ask that you champion the reintroduction of this legislation and work with your colleagues to ensure it advances through the legislative process during this session.
